This document applies to all Out of the Blue websites (referred to as ‘web properties’) and any subdomains/social media pages run by Out of the Blue Arts & Education Trust and its subsidiaries (referred to as ‘web properties’). By using the Out of the Blue web properties, the user agrees and understands these terms. Please also see The Bongo Club’s Terms & Conditions.
Section 2) Privacy Policy, Cookies and Gathered Statistics
Out of the Blue web properties do not automatically track or gather names, email addresses or any other personally identifying information. Any information of this nature that we receive must be explicitly permitted by the user (i.e through the act of the user signing up for a newsletter).
Our website uses cookies to distinguish you from other users on the site. Cookies also provide us with information about how this website is used so we can keep it as up to date, relevant and error-free as possible. We use third party cookies (cookies defined by the I.C.O. as “a small file, typically of letters and numbers, downloaded on to a device when the user accesses certain websites.”) to integrate popular social networks (Facebook, Twitter & Google+) meaning if you’re logged in to a social media site, they may track your browsing data. To better understand our audience, Out of the Blue web properties use Google Analytics. We may use Analytical/performance cookies to collect information about your computer, including, but not limited to, your IP address, operating system, location and browser type for system administration and in order to create reports. This is statistical data about our users’ browsing actions and patterns, and does not personally identify any individual.
We use Mailchimp to manage mailing lists and provide updates to consenting users. For accordance on how we use data collected (names and email addresses), please see ‘Section 3) Data Protection’ below.
Section 3) Data Protection
Any information gathered using our web properties (mentioned in this document) is processed in accordance with the Data Protection Act 1998 (latest revision) and the G.D.P.R. (2018).
We do not require users to enter personally-identifiable information to view or share events and general pages on our web properties.
We take data protection very seriously and will not pass on, resell or lend personal data to third-parties for commercial purposes unless consent is explicitly granted by the user when they sign up and/or purchase a ticket. This includes, but is not limited to; contact forms, emails, comments, enquiries & newsletters.
We handle users’ data with the utmost respect. Users’ data will only be held or used with the relevant mailing list they have consented to, and are not under any circumstances sent unsolicited communications. We regularly review our internal data handling policies and practices.
Users may unsubscribe from mailing lists at any time by clicking the “unsubscribe” link at the bottom of any email they receive. For information gathered and/or handled by third parties, please see section ‘3.1) Data Protection: Third Party Events’.
If you wish to request a copy, modify or request deletion of your personally-identifiable data, please email our Data Protection Officer (Harald Tobermann) at dpo@outoftheblue.org.uk to receive a response within 30 days.
Our data retention period is seven years. Any personally-identifiable information that was collected more than seven years ago without renewed consent will be deleted.
If you use the Out of the Blue web properties outside the EU, your information may be transferred using servers outside the EU in order to provide you with those services. We aim to ensure our service providers and processors are transparent and any third party processor we use to store data has a renewed EU/Swiss Privacy Shield certification.
Section 3.1) Data Protection regarding Third Party Events
Third-party events organisers may require personal information of customers. For third-party events, the event organiser may give the option to the customer at the time of ticket purchase to provide their personally-identifiable information to the event organiser. Once the customer opts to provide name and contact information to the third party event organiser, or purchases tickets to which an event organiser requires the customer’s personally-identifiable information, We are not responsible for third party event organisers use of information.
Section 4) Accessibility Statement
We have taken measures to ensure our web properties are accessible to all users. We have tested and are happy that our web platforms are navigable using most mainstream screen-readers. We have tested and are content that our navigation is fit for purpose but do greatly appreciate feedback. If you have trouble navigating our website or wish to feedback about our accessibility, please use the website feedback form.
Our accessibility guidelines are based on WCAG 2.0.
We reserve the right to disallow access to our web properties if the user is suspected to have taken part in unlawful activity.
Section 5) Information and content presented on Web Properties
Classes and events (including workshops and exhibitions) are not organised by Out of the Blue unless otherwise stated. Out of the Blue does not assume responsibility for cancelled or changed third party classes or event dates as any information listed there is the latest information we’ve received. Any and all dates listed on these web properties are for reference only and event dates, times, prices and availability are subject to change. It is recommended to contact the third party event organisers for the most up to date information. The third party event organisers contact information may be found on the class and event pages.
OOTB works in partnership to provide economic, creative, social and educational opportunities, to a significant number of people to make a real difference to their lives.
Content featured on our website is in accordance with our Equalities Commitment.
Events and space hires are subject to our Bookings Policy.
We do not prioritise certain classes or events over others but reserve the right to feature some and not others on our homepage or publicity.
Any multimedia content supplied by a third party to Out of the Blue for use on the website is of the discretion of the sender. The individual who sends the content must ensure that they have the rights to distribute the content via a compatible license. We reserve the right to remove an offending piece of multimedia either by request of the copyright holder or staff deeming it inappropriate. content removal requests may be sent to marketing@outoftheblue.org.uk.

Our office is located at 36 Dalmeny Street, Edinburgh, United Kingdom EH6 8RG. The opening hours of the office is 9am to 5pm Monday to Friday and reception is open from 10am to 5pm Monday to Saturday (excluding holidays).
Section 3) Digital Security
We actively take steps to ensure our online platforms are secured to meet industry standards. Since July 2019, we hold a Cyber Essentials certification from the UK National Cyber Security Centre.
Section 4) CCTV notice
Our spaces may use CCTV to ensure the safety of members of the public and staff and is internally audited annually. As of May 2019, the operator is Jack Caldwell. For requests, please email technical@outoftheblue.org.uk or formally request through our Data Protection Officer, whose contact details and standard response times are published in “Website Terms & Conditions: Section 3) Data Protection” of this document.
